These Terms of Service (“Terms”) govern your access to and use of services provided by JPF Towing (“we”, “our”, “us”), including our website at www.jpftowing.com, phone/SMS communications, dispatch, and payment processing (collectively, the “Services”). By using the Services, you agree to these Terms.

1) Service Scope

We provide towing and roadside assistance subject to vehicle condition, safety, and availability. Response times and estimated arrival times are targets, not guarantees, and may vary due to traffic, weather, or safety conditions.

2) User Responsibilities

  • Provide accurate information (location, vehicle, contact).
  • Ensure a safe environment for operators to perform services.
  • Comply with applicable laws and avoid misuse of the Services.

3) Quotes, Fees, and Payments

  • Quotes are estimates based on the information you provide and may change due to distance, conditions, wait time, vehicle state, or add-ons.
  • You authorize charges to your selected payment method for completed services and applicable taxes/fees.
  • We may use third-party processors; by paying you also agree to their terms and privacy policies.

4) Cancellations & No-Shows

Cancellations after dispatch or failure to be present at the pickup may incur a fee to cover travel and time. Weather or safety-related cancellations by us will not incur such fees.

5) Communications & SMS Terms

By providing your phone number and opting in, you agree to receive operational texts (e.g., confirmations, ETA, updates, receipts). Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Text STOP to end; text HELP for assistance or call +1 (407) 569-7172. Consent to receive messages is not a condition of purchase.

6) Prohibited Uses

  • Interfering with or attempting to gain unauthorized access to the Services.
  • Submitting false, harmful, or illegal requests.
  • Harassing, threatening, or endangering staff or others.

7) Intellectual Property

All content, trademarks, and materials on the Services are owned by or licensed to JPF Towing and protected by law. You may not copy, modify, or distribute content without permission.

8) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

9) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JPF TOWING AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM.

10) Indemnification

You agree to indemnify and hold harmless JPF Towing, its officers, employees, and agents from claims, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services or violation of these Terms.

11) Changes to the Services

We may modify or discontinue parts of the Services at any time. Material changes to these Terms will be posted with an updated “Last updated” date.

12) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Courts located in Florida shall have exclusive jurisdiction, unless otherwise required by applicable law.

13) Severability & Entire Agreement

If any provision is unenforceable, the remaining provisions will remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and JPF Towing regarding the Services.
